Trade name

The Trade Names Act takes the trade name to mean the name under which an enterprise is operated.

A trade name may not be misleading with regard to the type of enterprise (for example: B.V. while it concerns a Partnership (VOF)) nor with regard to the offered services or products. Furthermore, the name may not breach a trademark right already in existence. The name may also not be the same as an older trade name, if the use of the same name is expected to confuse the public (trade name law). A trade name must be registered in the commercial register of the Chamber of Commerce.
